THE LEBANESE CHANNEL AL MAYADEEN TV, PROMOTER OF ISLAMIST TERRORIST ORGANISATIONS, IS BROADCAST BY TWO EUTELSAT SATELLITES WITHOUT THE REQUIRED AUTHORISATION – THE ITALIAN AUTHORITY LAUNCHES AN INVESTIGATION PROCEDURE.
The Denis Diderot Committee is issuing a report on the Lebanese channel Al Mayadeen TV. This channel, broadcast to the Middle East, North Africa and Europe by two Eutelsat satellites from Italian territory, has not been authorized by the Italian regulatory authority, Agcom.
The report shows how the channel and its websites:
• spread anti-Semitic and Holocaust denial statements
• advocate terrorism by regularly giving space, in the form of columns or interviews, to the leaders of various Islamist terrorist organizations (Hezbollah, Hamas, Palestinian Islamic Jihad, Houthi regime in Yemen) and to various personalities promoting apology for terrorism. In particular, the pogrom of October 7, 2023 against the Israeli civilian population is praised as a major act of “resistance”. Crimes committed by Hamas against civilians are ignored while the bombings and the Israeli offensive in Gaza are the subject of disinformation.
• contribute to disinformation, in the Arab world and Arabic-speaking populations around the world, about Russia's war of aggression in Ukraine.
Initially, the Diderot Committee alerted the French regulatory authority, Arcom. Elements of information, provided by Arcom and the Secretary General of Eutelsat Group, made it possible to identify that the channel is relayed by two Italian teleports – including one belonging to Eutelsat – to two Eutelsat satellites (Hotbird 13G and Eutelsat 7 West A). Arcom made a referral to its Italian colleague and the Diderot Committee sent its report to the President of Agcom, expressing surprise that Al Mayadeen TV does not appear in the register of channels broadcast by satellite authorized by the Authority pursuant to Article 18 of Italian Legislative Decree No. 208/2021.
On December 6, 2023, Mr. Lasorella, President of Agcom, wrote to the Diderot Committee to confirm that the channel had not made any request for authorization and that he was therefore launching an investigation. It specifies that following receipt of the letter from ARCOM, the Authority immediately alerted police bodies, to verify the exact location of the uplinks, in order to establish any Italian jurisdiction and proceed with the arrangements provided for by the legislative decree no. 208/2021, national regulation implementing the Directive 2018/1808/EU on audiovisual media services.
The Diderot Committee thanks the Director General of Arcom and the President of Agcom for following up on its alert. It hopes that the investigation procedure launched by Agcom will be rapid and will result in the banning of uplinks by Italian teleports and sanctions against the various operators who have not complied with the legislation. It is surprised that Eutelsat accepted a channel that did not have the required authorization on one of its teleports and two of its satellites.
The Diderot Committee hopes that national authorities in Europe, and where appropriate the European Union, will take measures to ensure that the sites and accounts of Al Mayadeen TV, a promoter of anti-Semitism and terrorism, are banned on satellite cable, the Internet and social networks.
The Diderot Committee also invites regulatory authorities and European satellite operators to establish a register of uplinks which allow non-European channels to operate from European territory. It is not normal that the country of jurisdiction of these channels, within the meaning of the SMA Directive, is not immediately identifiable and that the sites of the competent authorities do not allow easy reporting, as is the case for national channels.

Le Comité Denis Diderot publie un rapport de signalement de la chaîne libanaise Al Mayadeen TV. Cette chaîne, diffusée vers le Moyen-Orient, l'Afrique du Nord et l'Europe par deux satellites Eutelsat depuis le territoire italien n'a pas été autorisée par l'autorité italienne de régulation, l'Agcom.
Le rapport montre comment la chaîne et ses sites web :

diffusent des propos antisémites et négationnistes de l’Holocauste

font l’apologie du terrorisme en donnant régulièrement la parole, sous forme de tribunes ou d’interview, aux dirigeants de diverses organisations terroristes islamistes (Hezbollah, Hamas, Jihad islamique palestinien, régime Houthi du Yémen) et à diverses personnalités faisant l’apologie du terrorisme. En particulier, le pogrom du 7 octobre 2023 contre la population civile israélienne est valorisé en tant qu’acte majeur de « résistance ». Les crimes commis par le Hamas contre les civils se trouvent occultés et les bombardements et l’offensive israélienne à Gaza font l’objet de désinformation

contribuent à la désinformation, dans le monde arabe et les populations arabophones dans le monde, sur la guerre d’agression de la Russie en Ukraine.
Dans un premier temps, le Comité Diderot a alerté l'autorité française, l'Arcom. Des éléments d'information, apportés par l’Arcom et le Secrétaire général d’Eutelsat Group, ont permis d’identifier que la chaîne est relayée par deux téléports italiens – dont un appartenant à Eutelsat – vers deux satellites Eutelsat (Hotbird 13G et Eutelsat 7 West A). L’Arcom a fait une saisine auprès de sa consœur italienne et le Comité Diderot a transmis son rapport de signalement au Président de l’Agcom, en s’étonnant que Al Mayadeen TV ne figure pas au registre des chaînes diffusées par satellite autorisées par l’Autorité en application de l’article 18 du Décret législatif italien no 208/2021.
Le 6 décembre 2023, M. Lasorella, Président de l’Agcom, a écrit au Comité Diderot pour confirmer que la chaîne n’avait fait aucune demande d’autorisation et que dès lors il lançait une procédure d’investigation. Il précise que suite à la réception de la lettre de l'ARCOM, l'Autorité a immédiatement activé ses organes de police, pour vérifier l'emplacement exact des liaisons montantes, afin d’établir toute juridiction italienne et procéder aux dispositions prévues par le décret législatif no. 208/2021, règlement national mettant en œuvre le Directive 2018/1808/UE sur les services de médias audiovisuels.
Le Comité Diderot remercie le Directeur général de l’Arcom et le Président de l’Agcom d’avoir donné suite à son alerte. Il espère que la procédure d’instruction lancée par l’Agcom sera rapide et aboutira à l’interdiction des liaisons montantes par les téléports italiens et à des sanctions contre les différents opérateurs qui n’ont pas respecté la législation. Il s'étonne qu'Eutelsat ait accepté sur un de ses téléports et deux de ses satellites une chaîne ne détenant pas l'autorisation requise.
Le Comité Diderot espère que les autorités nationales en Europe, et le cas échéant l’Union européenne, prendront des mesures pour que la chaîne TV, les sites et comptes d’Al Mayadeen TV, promotrice de l'antisémitisme et du terrorisme, soient interdits sur les satellite, les réseaux câblés ainsi que sur Internet et les réseaux sociaux.
Le Comité Diderot invite également les autorités de régulation et les opérateurs européens de satellite à établir un registre des liaisons montantes dont bénéficient, à partir du territoire européen, les chaînes extra-européennes. Il n’est pas normal que le pays de juridiction de ces chaînes, au sens de la Directive SMA, ne soit pas immédiatement identifiable et que les sites des autorités compétentes ne permettent pas un signalement aisé, comme c’est le cas pour les chaînes nationales.
